Terms and Conditions

Please read these Terms and Conditions carefully before using eleveraacademy.com, subscribing to our communications, purchasing any digital product, or participating in any Elevera community. By accessing the Site or purchasing or using any Product, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase any Product.

1. Who We Are and What These Terms Cover

The website eleveraacademy.com (the “Site”), the publications, newsletters, courses, guides, downloads, video lessons, workbooks, memberships, and community spaces offered through it (together, the “Products”), and all related content (the “Content”) are owned and operated by Elevera Academy, LLC (“Elevera,” “we,” “us,” or “our”). These Terms apply to the Site, the Products, and the Content wherever they are delivered, including through third-party platforms we use for checkout, email, and community hosting.

2. Eligibility

You must be at least 18 years of age to purchase a Product or participate in an Elevera community. By using the Site or purchasing a Product, you represent that you are 18 or older and have the legal capacity to enter into these Terms.

3. Digital Products — All Sales Are Final

Every Product Elevera sells is a digital product. Because digital content is delivered immediately and cannot be returned, all purchases are final. Elevera does not offer refunds, exchanges, credits, or cancellations for any Product, for any reason, including but not limited to: change of mind, dissatisfaction with the content, failure to use or complete the Product, purchase by mistake, or a decision that the Product was not what you expected.

By completing a purchase, you expressly acknowledge and agree that:

  • you are purchasing digital content that will be delivered to you immediately or made available to you immediately upon purchase;
  • you consent to immediate delivery and understand that, by consenting, you waive any right to cancel or withdraw from the purchase once delivery has begun; and
  • the purchase is final and non-refundable.

If you experience a technical problem accessing a Product you have purchased, contact hello@myelevera.com and we will restore your access. Access issues are resolved by delivering the Product, not by refunding it. A billing error, such as a duplicate charge for a single purchase, is corrected by reversing the erroneous charge; this is not a refund of the Product.

Initiating a chargeback or payment dispute on a completed digital purchase that has been delivered, in an attempt to circumvent this policy, constitutes a breach of these Terms. Elevera will contest such disputes and may terminate your access to all Products and communities.

4. Pricing and Payment

All prices are stated in U.S. dollars. Elevera may change prices, run limited-time launch pricing, or add or withdraw bonuses at any time. A price you paid is not adjusted if the price later changes, and a launch price is not extended after the launch window closes. Payment is processed by third-party payment processors; your use of those services is subject to their terms. Elevera does not store your full payment card details.

5. Your License to Use the Products

When you purchase a Product, Elevera grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use that Product for your own personal, non-commercial use. You may not:

  • share, resell, sublicense, rent, lend, or give away a Product, your login, or your access credentials;
  • copy, reproduce, republish, upload, post, transmit, distribute, or create derivative works from any Content, in whole or in part, except for printing a single copy of a PDF for your own personal use;
  • screen-record, download, or otherwise capture video lessons or member sessions;
  • use any Content to create, teach, or sell a competing product, course, or service;
  • remove any copyright, trademark, or proprietary notice.

Access is granted to the single individual who completed the purchase. Elevera monitors for shared or simultaneous access and may terminate access, without refund, where sharing is detected. Elevera may update, revise, or retire Content over time; the Products are sold as delivered at the time of purchase, and future updates, where offered, are provided at Elevera’s discretion.

6. Intellectual Property and Trademarks

All Content on the Site and in the Products, including text, graphics, images, video, audio, downloadable files, and the selection and arrangement of the foregoing, is the property of Elevera Academy, LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws. Nothing in these Terms transfers any ownership interest to you.

Elevera, Elevera Academy, The Elevera Edit, Aesthetic Reflections, The Elevera Society, Elevera Studies, From The Edit, Bedside Manner, The Elevera Brief, and The Elevera Collective are trademarks or service marks of Elevera Academy, LLC. Unauthorized commercial use is prohibited. Mentions of professional societies, regulatory bodies, brands, or other organizations are for informational reference only and do not imply endorsement, affiliation, or sponsorship.

7. Community and Membership Conduct

Some Products include access to a private community or membership space hosted on a third-party platform. Participation is a privilege, not a right. Within any Elevera community you agree to:

  • treat other members and Elevera staff with respect; no harassment, bullying, or discriminatory conduct;
  • keep what is shared in the community confidential — do not screenshot, quote, or share other members’ posts, questions, or personal details outside the community;
  • refrain from promoting or selling your own products, services, or practice unless expressly invited to;
  • refrain from giving other members medical advice or presenting yourself as a clinician to other members unless you are one and are clearly identified as such;
  • post only content you have the right to share.

Elevera may remove content, suspend, or permanently remove any member who violates these standards, at Elevera’s sole discretion and without refund. Memberships billed on a recurring basis may be cancelled by you at any time to stop future billing; cancellation takes effect at the end of the current billing period, and amounts already paid are not refunded.

8. Communications and Newsletter

By subscribing to Aesthetic Reflections or any Elevera list, or by purchasing a Product, you consent to receive email communications from Elevera, which may include educational content, product updates, and promotional offers. You may unsubscribe at any time using the link included in every email. We do not sell or share subscriber data with third parties. Our handling of your personal information is described in our Privacy Policy, which is incorporated into these Terms.

Elevera cannot answer individual medical questions by email or within any community. Replies you receive are for general educational purposes and are not a substitute for an in-person evaluation by a qualified provider.

9. Medical and Educational Disclaimer

A short-form version of this disclaimer appears at the front of each publication, guide, and course material available through the Site. Each such material is governed by, and incorporates by reference, this full disclaimer and these Terms.

Educational Purposes Only

The information contained on the Site and in the Products is intended for educational and informational purposes only and is not intended as medical advice, professional diagnosis, opinion, or treatment. The Content, including text, graphics, images, video, and other materials, is based on clinical experience and evidence-based research but does not constitute personalized medical recommendations.

Not a Substitute for Professional Medical Care

The Content is not a substitute for professional medical advice, diagnosis, or treatment. Elevera Academy, LLC makes no representations, warranties, or guarantees regarding specific outcomes, results, or benefits from following the information, protocols, or treatments described in any Product. Individual results will vary based on numerous factors including but not limited to age, genetics, overall health status, lifestyle factors, adherence to protocols, and individual response to treatments.

Treatment Risks and Complications

All aesthetic treatments, medications, and procedures carry inherent risks and potential complications. Some treatments discussed in the Content require administration by qualified, licensed medical professionals in appropriate clinical settings. Improper use or administration can result in serious injury, disfigurement, or other adverse outcomes.

Emergency Medical Situations

IF YOU THINK YOU MAY HAVE A MEDICAL EMERGENCY, CALL YOUR DOCTOR OR 911 IMMEDIATELY. Do not rely on the Content to address acute medical situations.

Product and Treatment Mentions

11. Disclaimer of Warranties

ELEVERA ACADEMY, LLC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE COMPLETENESS, ACCURACY, RELIABILITY, SUITABILITY, OR AVAILABILITY OF THE SITE, CONTENT, OR PRODUCTS. ANY RELIANCE YOU PLACE ON THE CONTENT IS STRICTLY AT YOUR OWN RISK. ELEVERA ACADEMY, LLC MAKES NO REPRESENTATION OR WARRANTY RELATING TO ANY INFORMATION, SERVICES, OR MATERIALS PROVIDED IN RELATION TO THE CONTENT OR PRODUCTS. ANY IMPLIED WARRANTIES OF NON-INFRINGEMENT, TITLE, FITNESS FOR A PARTICULAR PURPOSE, AND MERCHANTABILITY ARE EXPRESSLY EXCLUDED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEVERA ACADEMY, LLC, ITS OWNERS, AUTHORS, EMPLOYEES, AGENTS, AFFILIATES, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR INJURY, ADVERSE REACTIONS, LOSS OF INCOME, EMOTIONAL DISTRESS, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF OR RELIANCE ON THE SITE, CONTENT, OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER ARISING UNDER THEORY OF CONTRACT, TORT, NEGLIGENCE, OR OTHER THEORY OF LIABILITY.

ELEVERA ACADEMY, LLC’S TOTAL LIABILITY UNDER THESE TERMS WILL BE LIMITED TO DIRECT DAMAGES NOT TO EXCEED THE AMOUNT PAID BY YOU TO ELEVERA ACADEMY, LLC FOR THE PRODUCT GIVING RISE TO THE CLAIM, EXCLUDING ANY ELEMENT OF SUCH AMOUNT THAT IS ATTRIBUTABLE TO THIRD-PARTY COSTS. UNDER NO CIRCUMSTANCES, HOWEVER, SHALL ELEVERA ACADEMY, LLC’S LIABILITY EXCEED ONE HUNDRED AND NO/100 DOLLARS ($100.00).

13. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS ELEVERA ACADEMY, LLC, ITS OWNERS, AUTHORS, EMPLOYEES, AGENTS, AFFILIATES, AND CONTRIBUTORS FROM ALL CLAIMS, DAMAGES, OR EXPENSES ARISING FROM YOUR USE OF THE SITE, CONTENT, OR PRODUCTS.

14. Termination

Elevera may suspend or terminate your access to the Site, any Product, or any community at any time, with or without notice, for conduct that Elevera believes violates these Terms or is harmful to other users, to Elevera, or to third parties. Termination for breach does not entitle you to a refund. Sections 3, 5, 6, and 9 through 17 survive termination.

15. Governing Law, Venue, and Jury Waiver

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict-of-law provisions. The parties consent to exclusive jurisdiction and venue in Columbia County, Georgia, or the U.S. District Court for the Southern District of Georgia, and waive any rights they may have to assert jurisdiction or venue in any other forum.

THE PARTIES HEREBY WAIVE ANY RIGHTS THEY MAY HAVE TO TRIAL BY JURY IN REGARD TO ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, THE CONTENT, OR THE PRODUCTS.

16. Changes to These Terms

Elevera may revise these Terms at any time by posting an updated version on the Site with a new “Last Updated” date. Changes take effect when posted. Your continued use of the Site or any Product after changes are posted constitutes acceptance of the revised Terms. The Terms in effect at the time of your purchase govern that purchase.

17. General

These Terms, together with the Privacy Policy and any product-specific terms presented at checkout, constitute the entire agreement between you and Elevera regarding the Site and Products. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Elevera’s failure to enforce any provision is not a waiver of that provision. You may not assign these Terms; Elevera may assign them without restriction.

18. Consent

By viewing and using the Site or purchasing or using any Product, you agree to all of the above Terms voluntarily and of your own free will. This consent cannot be rescinded.
